GENERAL TERMS AND CONDITIONS
1. VALIDITY OF GENERAL TERMS AND CONDITIONS
These Terms and Conditions (the "Terms and Conditions" or these "Terms") constitute a legally binding agreement between you ("Customer" or "you") and Esimity UG (haftungsbeschränkt), headquartered in Charlottenburg, Berlin, Germany ("esimity", "we", "our" or "us") and govern your use of our products, services, mobile application (the "App"), and website (the "Site", and collectively with the foregoing, the "Services").
The following Terms and Conditions are provided on the website https://www.esimity.com. esimity may accept variant clauses only in the case of an explicit written agreement.
These Terms apply to all categories of individuals and entities who interact with esimity's Services:
- End Users: Individuals who purchase and use esimity eSIM data plans directly.
- Business Users: Companies or organizations that purchase esimity products for resale or distribution.
- End Customers: Individuals who receive services provided through a Business User.
- Job Applicants: Individuals who apply for employment at esimity.
The term "Customer" refers collectively to all of the above, as applicable. Where you use a specific esimity product or program (e.g. affiliate program, business partner platform, API partnership, or enterprise services), additional or separate terms may apply and are incorporated by reference.
By clicking "I Agree", registering for an account, downloading the App, or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. You must be at least 18 years old (or the age of majority in your country) and have the legal capacity to enter into this agreement.
Any personal data you submit to esimity or which esimity collects about you is governed by our Privacy Policy.
2. DESCRIPTION OF SERVICES
2.1 Using the Services
esimity is a reseller of eSIM data plans sourced from third-party providers. These plans can be purchased and installed on compatible devices, enabling Customers to access mobile data worldwide.
To use the Services, Customers must create an esimity account and provide accurate and up-to-date information. Customers are responsible for safeguarding their account credentials.
2.2 Registration
- End Users must provide their name and email.
- Business Users may be required to provide company information (name, address, contact details, VAT ID, etc.).
- End Customers' information is collected by the Business User providing the service.
2.3 Service Engagement
esimity strives to provide high-quality services but cannot guarantee uninterrupted or error-free connectivity, as actual performance depends on third-party networks.
2.4 Customer Obligations
Customers must not use esimity Services for unlawful, fraudulent, or abusive purposes. esimity may suspend or terminate Services if misuse is detected.
2.5 Device Compatibility
The Customer is solely responsible for ensuring that their device is eSIM-compatible and carrier-unlocked. No refunds will be issued if a device is incompatible.
2.6 Pay-as-you-go
Pay-as-you-go data usage is billed to your account balance according to the applicable tariffs. It is subject to these Terms and to any specific pay-as-you-go terms or information made available to you in the App or on the Site.
3. START, DURATION, AND TERMINATION OF THE CONTRACT
The service contract between esimity and the Customer begins upon completion of an order on esimity's website, app, or partner platform.
- For End Users, the contract ends when the purchased eSIM expires or is deleted from the device.
- For Business Users, the contract remains valid in accordance with agreed commercial terms or until formally terminated.
esimity may suspend or terminate your account or access to the Services at any time for breach of these Terms, suspected fraud or misuse, or for operational or legal reasons. Where the law requires it, we will give prior notice or reason where possible.
4. CHARGES AND PAYMENT
All prices are displayed in euros (€). For customers in Germany, prices include applicable German VAT. For customers in other EU countries, VAT may be applied in accordance with applicable law (e.g. One-Stop-Shop). For customers outside the EU, we do not apply VAT; prices are as displayed.
4.1 Payment Conditions
Accepted payment methods include:
- Credit/debit card
- Apple Pay / Google Pay
- Other providers displayed at checkout
Transactions are processed securely by third-party payment service providers.
4.2 Invoicing for Business Users
Business Users may receive invoices for bulk purchases. Invoices must be paid within the deadline stated. esimity may charge statutory late payment interest under § 288 BGB for overdue amounts.
4.3 Bundle Purchases and Affiliate Discount Restrictions
Customers who purchase credit bundles (special promotional offers where bonus credits are included) are not eligible to receive affiliate discounts for a period of one (1) year from the date of bundle purchase. This restriction applies regardless of whether the Customer becomes an affiliate partner or uses an affiliate code during this period.
Standard credit purchases (non-bundle purchases) are not subject to this restriction and may be combined with affiliate discounts as per the applicable affiliate terms and conditions.
This restriction is in place to prevent abuse of promotional bundle offers and to maintain fair pricing practices across all Customers.
4.4 Credits and Voucher Codes (Validity and Use)
Voucher codes. Voucher codes (including those purchased from esimity or received as a gift or promotion) are valid for three (3) years from the date of purchase or issue, in accordance with applicable law. After the expiry date, the code can no longer be used and any remaining value is forfeited.
Credits (account balance). Credits held in your esimity account may only be used to purchase or pay for esimity services (e.g. eSIM plans, pay-as-you-go use). They have no cash value and cannot be exchanged for cash, except where a refund is due under these Terms. Credits do not expire unless a specific offer or promotion states otherwise. Credits are non-transferable. If your account is closed (by you or by esimity), any unused credits may be forfeited unless otherwise required by law.
5. DELIVERY
After purchase, End Users will see their eSIM in their esimity account ("My eSIMs") along with installation instructions.
Business Users will access purchased eSIMs through the Partner Platform.
6. REFUND / CANCELLATION POLICY
Refund requests must be submitted within 30 days of purchase. esimity may attempt to resolve the issue within 10 business days before issuing a refund.
Refunds are only granted if:
- The eSIM cannot be installed due to a technical fault attributable to esimity or its providers.
- The eSIM cannot connect to the network despite correct installation and configuration.
Refunds are not available for:
- Expired eSIMs.
- Unused data after the validity period.
- Accidental or duplicate purchases.
- Incompatible or locked devices.
- Service issues outside esimity's control (coverage gaps, roaming restrictions, third-party failures).
Refunds are processed to the original payment method in EUR (€).
6.1 Voucher Code Refunds
Voucher codes are valid for three (3) years from the date of purchase or issue, in accordance with applicable law. After that they expire and cannot be used or refunded.
A refund for a voucher code bought from esimity is only available if: (i) the code is unused, and (ii) the refund is requested within 14 days of purchase. Only 90% of the voucher amount will be refunded (due to fees and processing costs). After 14 days, or once the code has been used or has expired, no refund is possible.
Voucher codes purchased from third-party providers (e.g. other online or retail stores) cannot be refunded by esimity. Refund requests for such codes must be made to the store where the code was purchased.
7. USE OF SERVICES
Services are provided for personal and lawful use only.
Unauthorized resale, redistribution, or fraudulent use is prohibited and may result in termination without refund.
8. LIMITATION OF LIABILITY
esimity is a reseller and does not operate its own mobile network.
Service quality depends on third-party providers; esimity does not guarantee uninterrupted coverage.
esimity's liability for direct damages is limited to the total amount paid for the affected eSIM plan.
esimity is not liable for indirect damages, including lost profits, data, or business interruptions.
esimity is not liable for failure or delay in performance due to circumstances beyond its reasonable control (e.g. force majeure, third-party provider failures, acts of government, natural disasters).
9. PRIVACY & DATA PROTECTION
Esimity UG (haftungsbeschränkt) processes personal data in compliance with the EU General Data Protection Regulation (GDPR). For more details, see our Privacy Policy.
10. GOVERNING LAW & JURISDICTION
These Terms are governed by the laws of Germany.
Disputes will be handled by the courts of Charlottenburg, Berlin, Germany, unless mandatory EU consumer protection law requires otherwise.
11. CHANGES TO TERMS
esimity may update these Terms from time to time. Updates are effective upon publication on our website. Continued use of the Services constitutes acceptance of the updated Terms. For material changes, we may notify you by email or in the App where required by law.
12. SEVERABILITY & ENTIRE AGREEMENT
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in effect. These Terms, together with the Privacy Policy and any other policies referred to herein, constitute the entire agreement between you and esimity regarding the Services.
